For the Petitioner Learned Advocate for the petitioner submits that the petitioner was arrested and is in custody for about two years and three months. In the meantime, a complaint has been filed before the Learned Jurisdictional Court and the Learned Trial Court has been pleased to frame charges and proceeded with the trial of the case.

It has been brought to the notice of this Court that the prosecution, being the Narcotic Control Bureau, has relied upon eight witnesses. However, till date, only one witness has been examined and for the last seven dates, no witness turned up for giving evidence in Court in support of the prosecution.

Having considered the plight as expressed by the present petitioner, I direct the Zonal Director, Narcotic Control Bureau, Eastern Zone, to ensure regarding the production of the witnesses on the date so fixed before the

learned Trial Court. The Learned Trial Court would directly communicate with the Zonal Director, In Charge of Eastern Zone. No unnecessary adjournment should be granted to either of the parties and the Learned Public Prosecutor conducting the case would produce materials, exhibits and the documents on the date so fixed for examination of the witness concerned. A schedule be fixed consisting of three dates and such schedule be fixed once in a month, so that the, the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observation CRR 4231 of 2022 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
