Report submitted by the State be kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 24th January, 2022 but till date after framing of charge, no witness has been examined. It has been informed that the next date is fixed on 17th April, 2024.

In view of the other absconding accused persons the learned trial court will spilt up the case if it has already not been spilt up and proceed with the examination and will fix a schedule on and from 17th April, 2024 by way of three dates in a schedule to be fixed each and every month. No unnecessary adjournment be granted to either of the parties as it has been informed that 16 witnesses are to be examined. The learned trial court will communicate with the office of Superintendent of Police of concerned district immediately on witness being absent and it would be the duty of the office of the Superintendent of Police to

make witnesses available or in the alternative assign substantive reasons for absence of the witnesses concerned. Learned public prosecutor conducting the case would produce all the materials, documents and exhibits on the date so fixed for examination of the witnesses. The trial of the case would proceed in spite of any resolution of the local bar. All stakeholders would cooperate with the trial court to conclude the trial at the earliest. With the aforesaid observations, CRR 4188 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
