...for the alleged contemnors Mr. Sandip Kumar Bhattacharyya, learned Counsel representing the alleged contemnors has filed an affidavit disclosing the proceeding before the Departmental Screening Committee (DSC) for appointment of the petitioners on compassionate ground.

We have been informed that the contempt proceeding was filed prior to our order dated 24th December, 2020, has been resurrected, as according to the petitioners, the order of the Tribunal has not been complied with.

Two parallel proceedings cannot continue. We feel that having regard to the order dated 24th December, 2020 by which we have extended the time for compliance of the order passed by the Tribunal, it is the Tribunal who should take a final decision with regard to the compliance of this order.

Under such circumstances, this contempt application stands disposed of by leaving it to the parties to raise all the points before the Tribunal.

A copy of the affidavit filed on behalf of the alleged contemnors is served upon the learned Advocate for the petitioners in Court today.
