Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that other than the statements of co-accused, there are no incriminating materials available against the petitioner. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that there are criminal antecedents of the petitioner pertaining to the same NDPS Act. Earlier, a direction was passed by this Court upon the petitioner to handover/supply his mobile phone number/s to the Investigation Officer. Instated, the petitioner had supplied the old phone number of his wife and a new phone number obtained by the petitioner after the order was passed.

Considering the above, the other incriminating materials available in the case diary, the criminal antecedent of the petitioner and in view

of the restrictions contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
