From the report it appears that petitioner is a single teacher in the school in Physical Education as a result whereof steps could not be taken by respondent no.5 to forward his transfer application to the West Bengal Central School Service Commission for taking final decision. However, from the report it further appears that respondent no.5 vide memo dated 13th April, 2022 has made an attempt to find out willing teacher by requesting the heads of institutions of Paschim Bardhaman for making alternative arrangement by deputing alternative teacher in place of petitioner to facilitate his transfer.

Respondent no.5 is directed to make further endeavour to find out willing teacher who can man the post of the petitioner and which would permit petitioner to take transfer in terms of notification dated 3rd

January, 2022. If willing teacher is found who can be deputed in the resultant vacancy which is to be created after transfer of the petitioner, petitioner shall be transferred in accordance with law.

With the above observations, writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
