The petitioner claims to be a physically handicapped son of a deceased school teacher. He prays for grant of family pension in terms of the Government Memo No.325-SE(B)/IM43/2003 dated September 5, 2005. 3.

Application made by him seeking family pension is pending consideration at the end of the District Inspector of Schools (SE), Tamluk, Purba Medinipur.

Without entering into the merits of the same, the instant writ petition stands disposed of by directing the said DI of Schools to consider the petitioner's application strictly in light of the aforesaid memorandum at the earliest, but positively within a period of eight weeks from the date of communication of this order.

It will be open for the said respondent to check the medical documents of the petitioner to come to a final conclusion.

If the petitioner's prayer is allowed, then

necessary consequential steps shall be taken by the authority without any further delay.

Learned counsel for the petitioner shall forward a copy of the subject application, medical documents and the Government memorandum relied upon in support of such claim to the respondent authority at time of communicating this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
