PP Mr. Saryati Dutta ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for 215 days and there has been no recovery from the possession of the petitioner who was shown arrested in the instant case.

It has been emphasized by the learned advocate that the petitioner has been arrested on the basis of the statement of a co-accused.

Mr. Roy, learned Public Prosecutor, opposes the prayer for bail and submits that the petitioner has antecedents.

Having considered that there has been no recovery from the petitioner who has been shown arrested because of the statement of a co-accused, I am of the opinion that

further custodial detention of the present petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Goutam Mondal @ Boss @ Boss Goutam shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (under NDPS Act), Hooghly.

If on bail, the petitioner shall be physically present before the learned Special Court on each and every date so fixed by the learned trial court and meet with the Inspectorin-charge of Bhadreswar PS once in a fortnight until and unless further modified by the learned Special Court in seisin of the present case.

Accordingly, CRM(NDPS) 1424 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
