1. Affidavit of service is taken on record.

2. Learned counsel for the petitioner submits that he seeks to withdraw the present writ petition, having recently become aware that the construction undertaken by the private respondents, forming the subject matter of challenge herein, is being carried out pursuant to a duly sanctioned plan issued by the Dankuni Municipality.

3. Learned counsel further submits that the petitioner was previously unaware that the private respondents are in possession of a valid building permit granted by the Dankuni Municipality. He now intends to challenge the said building permit by filing a separate writ petition. In view thereof, the petitioner does not wish to press the present writ petition and seeks leave to withdraw the same, with liberty to take appropriate steps in accordance with law, including initiating proceedings against the said permit.

4. In light of the above submissions, the present writ petition is dismissed as withdrawn, with liberty granted

to the petitioner to take recourse to appropriate legal remedies, as prayed for.
