The petitioner is aggrieved by the action of the respondent no.7, the SBI Card authority.

Learned advocate appearing on behalf of the respondent no. 7 submits that the writ petition against the said authority will not be maintainable as the same is not an authority under Article 12 of the Constitution of India.

There is nothing to suggest that the SBI Card and the State Bank of India are the same authorities. SBI Card is submitted to be an absolute independent authority not related with the State Bank of India in any manner whatsoever.

There is no manner of financial or any form of control over the authority of the SBI Card by State Bank of India.

In view of the above, I am of the opinion that the writ petition against SBI Card will not be maintainable.

The writ petition stands dismissed as 'not maintainable'.

It will, however, be open for the petitioner to approach the appropriate forum for relief in accordance with law, if so advised.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
