1. Parties are represented through their respective learned counsel.
2. With the consent of the parties, the matter is finally heard. During the course of hearing, learned counsel for parties reached to a consensus. It is agreed that this PIL may be disposed of with direction to the concerned Block Land and Land Reforms Officer and that the petitioner may be permitted to file a fresh comprehensive representation for his present grievance before the concerned Block Land and Land Reforms Officer and in turn, the said authority may be directed to decide it in accordance with law after hearing all the affected parties.
3. In view of the consensus arrived at, this PIL is disposed of with following directions:-
(i) Petitioner may prefer a fresh comprehensive representation for self-same cause within 15 days along with a copy of this order and submit it before the concerned Block Land and Land Reforms Officer.
(ii) The said authority, in turn, shall consider the representation, hear all the affected parties and pass a reasoned order in accordance with law expeditiously, preferably within 90 days.
(iii) The out come shall be communicated to the parties.
4. The PIL stands disposed of without expressing any opinion on merits.
5. If said authority comes to the conclusion that doba/water body is illegally filled up by the parties, the said parties, who are responsible for such filling up shall bear the expenses.
6. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
