Supplementary affidavit and the affidavit-ofservice filed in Court today are taken on record. 2.

The petitioner is the husband of a deceased employee of a school. He prays for grant of family pension. An objection was raised by the District Inspector of Schools (SE), Birbhum, with regard to pay fixation of the employee.

Reference has been made to the memorandum approving the appointment of the deceased employee dated 7th October, 2013. Column-VI of the said memo mentions the date from which the appointment is approved. The approval was given from 8th October, 2013 and notionally from 2nd May, 2000.

Learned advocate for the petitioner draws attention of the Court to the averment made in paragraph 8 of the writ petition and submits that the petitioner foregoes the notional benefit and only prays for issuance of the benefit on and from 8th October, 2013 i.e. the date of approval of appointment of the employee.

As it appears that the employee expired more than two years back and the petitioner himself is a senior citizen, the District Inspector of Schools ought to take steps to regularize the family pension file of the petitioner in accordance with law.

The instant writ petition, accordingly, stands disposed of by directing the District Inspector of Schools (SE), Birbhum, to take steps to ensure that the petitioner's family pension file is made ready and the family pension is disbursed in his favour without any further delay but positively within a period of twelve weeks from the date of communication of this order. 7.

The petitioner is directed to render all cooperation with the District Inspector of Schools for making the family pension file ready.

The writ petition stands disposed of.
