Affidavit of service filed by the petitioner is taken on record.

By the present writ petition, the petitioner seeks direction upon the respondent authorities to include the name of the petitioner in Pension Payment Order being PPO No.SEC/S/EMD/00053/2014 in place of Taslima Bibi and to release the family pension in favour of the petitioner.

The petitioner contends that the husband of the petitioner, namely, Imdadul Haque Molla was a Teacher in Gimageria Welfare High Madrasah (H.S.) who retired from service on 28th February, 2014. At the time of retirement the concerned employee was married to one Taslima Bibi. The name of said Taslima Bibi was recorded in the Pension Payment Order. On 29th March, 2014, the said Taslima Bibi died. The concerned employee thereafter married the petitioner on 29th

March, 2015. Thereafter on 18th July, 2022 the husband of the petitioner submitted a letter before the concerned District Inspector of Schools (S.E.) seeking for necessary corrections and changes in the Pension Payment Order. The concerned employee expired on 20th September, 2024. However, the prayer for correction is still pending consideration. Hence, this writ petition.

Mr. Atarup Banerjee, learned Advocate appearing for the petitioner submits that a letter has been issued by the District Inspector of Schools (Secondary Education), Purba Medinipur on 4th December, 2025 directing for submission of certain papers for grant of family pension in favour of the petitioner. He seeks that the matter be relegated to the District Inspector of Schools (Secondary Education), Purba Medinipur to decide the prayer of the petitioner for grant of family pension upon correction of details in the Pension Payment Order. He files a copy of the letter dated 4th December, 2025 under Memo No.414-Law of the District Inspector of Schools (Secondary Education), Purba Medinipur which is taken on record.

Mr. S. S. Arefin, learned Senior Advocate appearing for the State also concedes to such submission.

In view of the above submission, respondent no.2, the District Inspector of Schools (S.E.), Purba Medinipur is directed to consider the prayer of the petitioner for correction of Pension Payment Order and grant of family pension in her favour and dispose of the same by passing a reasoned order in accordance with law upon

notice to the petitioner within a period of three months from the date of submission of relevant documents as noted in the letter of the District Inspector of Schools (Secondary Education), Purba Medinipur dated 4th December, 2025.

Learned advocate for the petitioner is directed to communicate this order to the respondent no.2, the District Inspector of Schools (S.E.), Purba Medinipur for necessary action.

With the above direction, the writ petition being WPA 25297 of 2025 stands disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 10.

Interim order, if any, stands vacated.

All connected applications, if any, stand disposed of. 12.

There shall be no order as to costs.

13.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
