Learned counsel for the petitioner submits that the petitioner does not intend to proceed with the matter any further.

In view of the above, the civil revisional application is dismissed as withdrawn with liberty to file afresh on the self same cause of action.

The order dated August 26, 2025 passed by the learned Civil Judge (Jr. Division), 3rd Additional Court at Alipore in Title Execution No. 04 of 2013 shall continue to operate.

On the prayer of the petitioner, liberty is granted to take back the order impugned upon furnishing photocopy thereof.

5.

There shall be no order as to costs.
