Chuhelika Biswas Nee Roy v. State Of West Bengal And ANR
S/L-25 31-07-2023 KOLE CRR 4239 of 2022 Smt. Chuhelika Biswas nee Roy -Vs.- The State of West Bengal & Anr.
Mr. Tanmoy Ghosh, Mr. S. Das, ... for the State.
Ms. Sujata Das, who ordinarily appears for the State is directed to appear on behalf of the State. Her appointment should be regularized by the concerned authorities. None appears for the petitioner when the revisional application has been called. The same was mentioned at the instance of the learned Advocate for inclusion under the heading "Urgent Motion". I have considered the contents and the purpose for which the revisional application has been preferred. The main thrust of contention is transfer of Special Case No. 20 of 2021 from the learned Additional District Judge, 1st Court, Chinsurah, Hooghly to the learned 1st Court of Additional District Judge, Barasat, North 24 Parganas. The reasons assigned by the petitioner do not satisfy the grounds for transfer.
I have considered the contents and grounds assigned therein, the two reasons which have been assigned are security reason and distance from her residence. In case, there are any issues relating to security, the petitioner would communicate with the Inspector-in-Charge where she is residing, who would communicate with his counter part in the locale where the concerned court is situated i.e.
Judge, 1st Court, Chinsurah, Hooghly. No further interference of this court is required.
Learned Advocate for the State would communicate this order to the office of the Superintendent of Police, Hooghly, who would take necessary steps so that there is no insecurity faced by the petitioner while attending the court of learned Additional District Judge, 1st Court, Chinsurah, Hooghly. With the aforesaid observations, CRR No. 4239 of 2022 is disposed of.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this court. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. ( Tirthankar Ghosh, J. )
