In compliance of the order of this Court dated 11th January, 2023 officer concerned is personally present and submission has been made on behalf of the respondents that refund in question has already been made and grievance of the petitioner no more survives. Learned advocate appearing for the petitioner does not dispute this fact that the payment towards refund has already been made but he prays for payment of statutory interest.

Considering the facts and circumstances of this case and in view of the discussions made above, this writ petition being WPA 25597 of 2022 is disposed of. Petitioner is at liberty to pursue for his claim of interest in accordance with law.
