APP Ms. Paulami Bose ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for more than four years and five months and there has been no progress in the trial of the case.

It has further been stated that the petitioner is similarly placed as the another accused who has been granted bail in CRM(M) 1137 of 2025.

Learned advocate for the State, on the other hand, submits that the bail was granted only for the period of detention of the said accused and, at that stage, 12 out of 22 witnesses were already examined by the prosecution. It has also been contended that next date has been fixed for examination of the doctor on 3rd January, 2026.

Having considered the fact that in the last four months, about eight witnesses have been examined; last opportunity is granted to the petitioner, if within 60 days from 3rd January, 2026, the prosecution is unable to complete the evidence, the learned trial court would release the petitioner on bail. No unnecessary adjournment be granted to any of the parties. The trial of the case would continue inspite of any resolution of the local Bar. With the aforesaid observations, CRM(M) 2302 of 2025 is disposed of.
