Petitioner is aggrieved by the disturbance created by the local villagers over his property. State has submitted a report which reflects that the police authorities have drawn up proceedings under Sections 126/135 of the BNSS against the private respondents for maintaining peace and tranquility.

In case the learned Executive Magistrate finds that these private respondents are adamant in their act and actions, in such case, the bond which would be furnished at the behest of the private respondents, the learned Executive Magistrate will see to it that the same is adhered to and the learned Executive Magistrate will not hesitate to pass directions in the bond. In case, there is further

breach of the peace directions be passed upon the private respondents to stay outside the jurisdiction of the said Police Station.

Police report so submitted by the State be kept with the record.

Police would continue to keep a vigil and ensure that no untoward incident takes place at the behest of any of the parties.

With the aforesaid observations, WPA 26168 of 2024 is disposed of.

There will be no order as to costs.

A copy of the report has been handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
