Abdul Hai -vsThe State of West Bengal Mr. Subir Ganguly ...for the petitioner Mr. Bidyut Kumar Roy Ms. Manisha Sharma ... for the State Mr Subir Ganguly, learned counsel representing the petitioner, submits that the petitioner has taken "no objection" from the advocate-on-record long back. Therefore, he submits that he has no instructions in the matter. The matter is appearing in the list since February 2022.

I do not find any reason to adjourn the case suo motu. I am inclined to dispose of the matter on merits based on the materials available with the record.

Sk. Abdul Hai has been arrayed as an accused in Panskura P.S. Case No. 5 of 2003 under sections 147/148/149/323/427/325/380 IPC dated January 19, 2003, registered at the behest of one Sk. Arab Billah. He has filed this revisional application seeking quashment of charge-sheet submitted in connection with the aforesaid police case corresponding to GR Case No.33 of 2003 but without impleading the de facto complainant.

It appears that after investigation police submitted charge-sheet which speaks of existence of alleged offence prima facie. I do not find any reason to invoke the provision of section 482 CrPC to quash the proceeding.

Accordingly, this criminal revisional application is dismissed, however, without any costs.

Let a copy of this order be sent to the learned trial court for information and necessary action.

Certified copy of this order, if applied for, shall be made available to the parties.
