Affidavit-of-service filed on behalf of the petitioner is taken on record.

Wife of a deceased Group-D employee of a government aided school has come up with the present writ petition.

The husband of the petitioner was a Group-D staff of a government aided school who died-in-harness on 28th November, 2018 and after death by issuing Pension Payment Order on 1st July, 2024, terminal benefits including death gratuity was released in favour of the petitioner. The petitioner being widow prays for interest on delayed payment of gratuity after the death of her husband.

The State/respondents are represented by learned advocate.

Accordingly, the Director, Pension Provident Fund and Group Insurance, West Bengal and the concerned Treasury Officer are directed to pay interest at the rate of 8% per annum to the petitioner on gratuity from the date following the date of death of the husband of

the petitioner till the date of release of gratuity, within a period of eight weeks from the date of communication of this order.

Since no affidavit is called for, the allegations contained in the writ petition are deemed not to have been admitted.

With the above observations, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
