1. Heard learned lawyers for the parties.

2. We have considered the materials on record.

3. Chemical report shows presence of heroin in the sample. Statements of witnesses and contemporaneous documents i.e. seizure memorandum establish recovery of narcotics above commercial quantity i.e 548 grams of heroin from the petitioner and co-accused.

4. In view of aforesaid facts and statutory restrictions under Section 37 of NDPS Act we are not inclined to grant bail to the petitioner.

5. Accordingly, prayer for bail is rejected.
