Exception filed by the petitioner in respect of the report filed by the respondent no.6 and the Rejoinder to such exception filed by the respondent no.6 be kept with the record.

The said rejoinder reflects that Haringhata Police Station Case No. 636/2024 dated 05.12.2024 has been registered under the relevant Sections of the SC and ST (Prevention of Atrocities) Act, 1989. A report has also been addressed to the learned Special Court, Krishnanagar, Nadia in respect of the status of the investigation.

Since the investigation has commenced and the primary grievance of the petitioner was that the complaint which was addressed to the SDO, Kalyani and the Inspector-in-Charge, Haringhata Police Station did not yield any result and the present circumstances have changed with the registration of the FIR, I am of the view that the purpose for which the writ petition has been preferred is subserved. As such, further pendency of this writ petition is unwarranted.

The police authorities are directed to keep a strict vigil and ensure that no breach of the peace takes place at the locale and/or any untoward incident results because of the strained relationship between the petitioner and the private respondents. Needless to state that this Court has not entered into the merits of the FIR and it would be for the investigating agency to arrive at its logical conclusion.

With the aforesaid observations, the writ petition being WPA 26163 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
