The compliance report filed today by learned Counsel for the alleged contemnor no. 1 be kept on record.

It transpires therefrom and from the submissions of learned Counsel for the alleged contemnor that even before the passing of the parent order of this court, the grievance of the petitioner had been mitigated. Not only was a hearing given, the OBC certificate, the cancellation of which was sought in the writ petition and directed by this court, had already been cancelled.

Learned Counsel for the alleged contemnor submits that due to a communication gap with their client, learned Counsel for the alleged contemnor was not in a position to apprise the court of the same at the time when the order under contempt was passed, which led to the present predicament.

Learned Counsel for the petitioner also submits that the grievance of the petitioner has since been mitigated. In such view of the matter, the compliance report filed today be kept on record. Since the grievance of the petitioner has been mitigated even prior to the passing of the order under contempt, there arises no question of keeping the contempt application pending further.

Accordingly, CPAN 1692 of 2024 is disposed of as infructuous without any order as to costs. (Sabyasachi Bhattacharyya, J.)
