Learned advocate appearing for the petitioner submits that the petitioner is in custody for 122 days and although chargesheet has been submitted, there are hardly any materials to support the contention of the prosecution.

Learned advocate for the State has produced the case diary and opposed the prayer for bail.

Learned advocate for the de facto complainant has also opposed the prayer for bail.

I have taken into account the materials which are appearing in the case diary and is of the view that cases of such

nature that issue relating to misrepresentation or deception is to be tested by the prosecution which can only be on dock. Accordingly, at this stage, I am not inclined to release the petitioner on bail.

Consequently, CRM(M)2308 of 2025 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
