Learned advocate appearing for the petitioners submits that both the petitioners are in custody for eight months and the investigating authorities have shown recovery of 490 grams of brown sugar. Learned advocate submits that there was gross non-compliance of the provisions of law so far as the memo of arrest is concerned as it was informed that the information has been passed to the father of the petitioner no.1, the father of the petitioner no.1 died 13 years back.

Learned advocate appearing for the State opposes the prayer for bail and submits that the recovery made from the petitioners is of commercial quantity.

Having considered that the rigors of Section 37 of the NDPS Act are applicable in the present case, I am not inclined to release the petitioners on bail.

Accordingly, CRM (NDPS) 1428 of 2025 is dismissed.

Petitioners as question of facts will canvass the issue to the learned trial Court.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
