(DB) No. 4095 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Joypur Police Station Case No. 149 of 2022 dated 15.09.2022 under Sections 498A/306/34 of the Indian Penal Code read with Section 3 of the Dowry Prohibition Act.

And In Re : Mithu Mandal @ Mondal ..... petitioner Mr. Siddhartha Sarkar ... for the petitioner Mr. Prasun Kumar Datta, learned APP Md. Kutubuddin Mr. Santanu Deb Roy ... for the State Learned Counsel appearing for the petitioner submits she is the mother-in-law of one of the victims. She subjected the victim housewife to torture. Husband of the victim housewife i.e. son of the petitioner objected. Subsequently, both of them committed suicide. Petitioner prays for bail. Learned Counsel appearing for the State opposes the prayer for bail and submits investigation is in progress. We have considered the materials on record. Statements of witnesses show that the petitioner tortured the housewife who committed suicide within one year of marriage. Her husband had protested and committed suicide with her. Keeping in mind the aforesaid circumstances and as investigation is in progress, we are not inclined to grant bail to the petitioner at this stage.
