1. Learned counsel appearing on behalf of the petitioner submits that other than the statements of co-accused, there is no other materials available against the present petitioner.

2. Learned counsel appearing on behalf of the State relies on the report, which is taken on record and the case diary. She opposes the prayer for anticipatory bail and submits that apart from the statements of the co-accused, there were several phone calls made at the relevant time by the petitioner with the other principal accused who were arrested.

3. Considering the above and the other incriminating materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.
