23.11.2022 sdas rejected C.R.M. (DB) No. 4098 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Chanchal Police Station Case No. 369 of 2011 dated 22.11.2011 under Sections 302/34 of the Indian Penal Code.

And In Re : Saddam Hossain ..... petitioner Mr. Kalidas Saha ... for the petitioner Mr. Swapan Banerjee Mr. Suman De ... for the State Learned Counsel appearing for the petitioner submits he is in custody 122 days. It is also submitted that the incident occurred in the course of a quarrel between two children. Learned Counsel appearing for the State opposes the prayer for bail.

We have considered the materials on record. Petitioner is the principal accused who hit the victim on the head resulting in his death. He absconded for more than a decade. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
