Mohsin Reza @ Mohsin ... petitioner Mr. Tapodip Gupta ... for the petitioner Mr. Ranadeb Sengupta Ms. Trisha Rakshit ... for the State Learned counsel for the petitioner submits that other than the statement of a co-accused there is no other material available against the present petitioner.

Learned counsel for the State opposes the prayer for anticipatory bail and refers to a statement of a local villager who had seen the petitioner carrying two bags in a motorcycle. Later he came to know that the motorcycle was seized with a contraband and the petitioner was able to flee away.

Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities. (Jay Sengupta, J.)
