The issue has already been decided by this Court, In the matter of: Payel Jana (Panja) v. The State of West Bengal & Others. The judgment was delivered on July 19, 2023 in WPA 18770 of 2012.

Mr. Bhaaskar Prasad Vaisya, learned Additional Government Pleader, appears for the respondent nos.1 to 3 has confirmed this Court that the decision rendered In the matter of: Payel Jana (Panja) (supra) has not been appealed from and the same has been acted upon by the authorities.

Mr. Bikram Banerjee, learned counsel, appears for the writ petitioner, draws attention of this Court to

the application dated January 2, 2006, Annexure "P-4" at page 24 of the writ petition and submits that the petitioner duly submitted her application claiming the higher pay scale.

In view of the above, the respondent no.3 shall take the necessary and consequential step to release the higher pay scale and pay the petitioner accordingly, which shall be payable from the date of the application submitted by the petitioner dated January 2, 2006 immediately but positively within a period of three weeks from the date of communication of this order. With the above observation and direction, this writ petition, WPA 25340 of 2015, stands disposed of, without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
