Nobody is present on behalf of the accused/respondent. 3.
In pursuance of the direction, a report is submitted by the Officer-in-Charge, Durgapur Police Station, A.D.P.C. indicating that during pendency of this appeal, the sole accused/respondent was expired on 24th December, 2024. A photocopy of certificate of death issued by the concerned authority was collected and tagged with the report which also affirms the death of the said respondent.

As the sole accused/respondent has been expired during pendency of this appeal, the instant appeal stands abated against him.

It appears from the earlier order passed by this Court dated 10.06.2025 that although administrative notice was duly served upon the appellant, but despite receiving the notice, he did not appear before the Court.

As the sole appellant has already been expired, the instant appeal becomes infractuous.

I have perused the impugned judgment and order of acquittal passed by the learned Trial Court and I find nothing material in this appeal to interfere with the said impugned judgment and order of acquittal passed by the learned Trial Court.

Accordingly, the instant appeal be and the same is hereby dismissed on merit.

Thus, the criminal appeal is hereby disposed of.
10. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
