Ld. Advocate appearing for the petitioners submits that the petitioners have been falsely implicated in connection with the instant case and there is a counter case also in the same p.s.

The stage at which the petitioners approached this court was when the investigation of the case was continuing. More than 18 months have been passed since the commencement of the investigation and presumably the investigation, if not yet completed, would be in an advanced stage.

Having regard to the issue so canvassed in the present revisional application, I am of the view that the same are question of facts which can be gone into at the appropriate stage of the trial.

However, the petitioners would be at liberty to approach this court after the report under section 173 of the cr.p.c. is filed before the ld. Jurisdictional court and the documents under section 207 of the cr.p.c. are supplied. With the aforesaid observations, CRR 4222 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
