Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The petitioner alleges that despite an order of status quo passed by the learned civil Court in respect of the nature, character, possession and alienation of the property in question, the private respondents are continuing to disturb the peaceful possession of the petitioner in the property.
Learned counsel for the private respondents denies and disputes such allegation.
In view of an ad interim order of injunction by the learned trial Court, the petitioner is at liberty to approach the said learned Court in the event of violation of the said order or for implementation of the order.
In the meantime, the police authority shall ensure maintenance of peace and tranquility.
With the aforesaid direction the writ petition is disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
