The petitioner was not named in the FIR. After the principal accused was arrested, other persons were arrested, from whom illegal arms were recovered. They were granted bail by this Court after remaining in custody for 34 days. The anticipatory bail application of the owner of the shop, in respect of which the petitioner's name subsequently surfaced, had prayed for anticipatory bail, and the same was rejected. The present petitioner is in custody for about 100 days. There is no recovery of arms from him.

Learned counsel appearing on behalf of the State opposes the prayer for bail. She submits that as per the statement of the

local witness, the petitioner was the one who was running the shop along with owner of the shop, namely, Sushila Adhia. Considering the above, the other materials available in the case diary, the fact that some other co-accused were granted bail after about 34 days in custody and considering the fact that the petitioner is in custody for about 100 days, I am inclined to grant bail to the petitioner.

Accordingly, I direct that the petitioner, namely, Sk. Manu @ Khan Saheb shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore and shall meet the I.O. once a fortnight until further orders and on further condition that the petitioner shall not enter the jurisdiction of Barrackpore Commissionerate except for attending the Court in the present case or in respect of any other case.

The application for bail is, accordingly, allowed. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
