The petitioner was suspended from service on July 25, 2014 and implicated in criminal proceedings and remained in custody.

The petitioner retired from service on March 31, 2015. The petitioner has been issued Pension Payment Order and has been receiving pension with effect from June, 2016. He claims arrears of pension, arrears of salary and all consequential benefits from the date of suspension.

The petitioner had approached the concerned Sub-Inspector of Schools for the first time in the year 2023 and made representations on August 10, 2023 and August 28, 2023.

In such circumstances, the respondents shall pay the arrears to the petitioner, of both pension and salary, within a period

of 1 month from date together with interest @ 5% per annum.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
