Perused the case diary.
The prosecution case is that over a dispute between neighbours, an altercation took place. Three persons received injuries, one on the scalp. A charge sheet was submitted against 11 accused, although the FIR was registered against as many as 16. There was a counter case filed as well.
Considering the materials available in the case diary, the fact that there are case and counter case and charge sheet has been granted, although I am inclined to grant anticipatory bail to the petitioners, their movement need to be restricted for a limited period. Accordingly, the application for anticipatory bail of the petitioners is allowed.
In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall not threaten or intimidate witnesses. The petitioners shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date.
The petitioners shall stay outside the jurisdiction of Baishabnagar Police Station for a period of two months from this date, except for attending the jurisdictional Court or meeting the Investigating Officer.
