1. The petitioner no. 1 is a registered association of clerks represented by the petitioner no. 2, its Secretary.

2. They allege that the clerks of the school are allotted duties not meant for Group-C Category. The clerks intend to perform their work with dignity which they feel is being infringed upon by the school authority.

3. A representation from the clerks' association made before the West Bengal Board of Secondary Education is pending consideration.

4. None represents the Board. In the absence of the Board, the issue cannot be decided conclusively.

5. In view of the above, the instant writ petition is disposed by directing the Secretary of the West Bengal Board of Secondary Education to

take a decision on the representation made by the petitioners strictly in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order.

6. An opportunity of hearing shall be granted to the representatives of the petitioner no. 1 and the school authority prior to taking final decision in the matter.

7. A reasoned order shall be passed and communicated to the parties immediately thereafter.

8. Learned advocate for the petitioners is directed to forward a copy of the said representation to the aforesaid respondent at the time of communicating the order of the Court.

9. The writ petition stands disposed of.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
