Pursuant to an earlier order of Court, the respondent CESC has filed an inspection Report. It appears from the Report that despite the objection raised by the private respondent, a fresh electricity connection can be granted to the petitioner by laying an underground service cable. In such circumstances, the respondent-CESC submits that they have no objection to provide such electricity connection.
On behalf of private respondent, it is submitted that there are existing civil disputes by and between the petitioner and the private respondent. It is also submitted that there is an
error in the application form filed before the CESC and the PIN Code number as submitted by the petitioner is incorrect. It is also submitted that a writ petition has been filed challenging the sanction plan which is pending before this Court. In view of the fact, that the petitioner claims an essential service and the respondentCESC are ready and willing to provide the same, there is no scope of adjudication of this dispute in this proceeding. All points raised on behalf of the private respondents are purely civil disputes which are beyond the scope of this proceeding and inconsequential insofar as grant of an essential service being provided is by CESC.
In such circumstances, WPA 25646 of 2025 stands disposed of by directing the respondent-CESC to provide an electricity connection to the petitioner in accordance with law after compliance of all statutory formalities. In providing such connection, the respondent CESC is at liberty to take police assistance, if necessary. The costs of any such police assistance are to be borne by the petitioner exclusively.
It is made clear that there has been no adjudication on the private civil disputes raised by the private respondent. The grant of the above
connection would not create any equity in favour of the petitioner.
