Grievance of the petitioner is after written test a merit list was prepared for holding interview where petitioner's name was appearing before one Rekha Bera but Rekha Bera was called for personality test whereas right of the petitioner to participate in personality test was denied on diluting merit position of the petitioner in the said list. Appreciating the grievance of the petitioner, court by passing order dated 13th November, 2024 directed West Bengal Madrasah Service Commission to file a report in the form of affidavit and same has been filed today and taken on record.

On perusal of the statements made in paragraph 8 of the said report it appears that said Rekha Bera

obtained 15 marks which was above the cut off marks whereas petitioner obtained 4 marks that is far below the cut off marks; therefore, petitioner did not come within the zone of consideration. It is also submitted that documents which are annexed at pages 15 and 16 of the writ petition are not related to each other. These are parts of two separate documents.

Since petitioner failed to obtain requisite marks, this court does not find merit in this writ petition and same stands dismissed.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
