1. The report filed earlier by the State sufficiently explains that there is no inordinate or undue delay in sending the FIR to the original court having jurisdiction in the matter.

2. Commercial quantity of Phensedyl syrup containing Codeine Phosphate was seized from a motorcycle belonging to this petitioner. In view of the restrictions in Section 37 of the NDPS Act, we are not inclined to enlarge the petitioner on bail, at this stage.

3. The application for bail is, thus, dismissed.

4. The petitioner complains that even charge has not been framed till date and he is in custody for more than nine months.

5. We direct the learned trial Court to expedite the trial to the fullest extent and take the trial to its logical conclusion on an early date without granting unnecessary adjournments to either of the parties and if necessary, by fixing frequent schedules for examination of witnesses.
