Mr. Masud Karim Mr. Abhijit Chatterjee ..for the petitioner The revisional application has been preferred for quashing of the proceeding arising out of Bhabanipur Police Case No. 401/2013.

Records of the case reflect that pursuant to charges being framed under Section 498A of the Indian Penal Code evidence has already commenced. As criminal proceedings are pending for about ten years, I direct the learned trial Court to fix at least one date in a month for the purpose of evidence of the case so that trial of the case can be taken to its logical conclusion within a reasonable period of time.

Copies of the orders so enclosed in the revisional application reflect that a date was fixed for examination of C.S.W. 4 and 5.

Having considered the same, I am not inclined to interfere with the merits of the case at this stage.

The petitioner would be at liberty to canvas all the issues in the revisional application at the stage of crossexamination and examination under Section 313 of the Code of Criminal Procedure and the defence witness stage.

With the aforesaid observations, CRR 4212 of 2023 is disposed of.
