The writ petitioners are the Headmasters of various Schools appointed pursuant to the 1st SLST in the year 2017. The petitioners claim an additional 3% increment in payment of emoluments in terms of the Circular dated 8th October, 2009, issued by the Secretary to the Government of West Bengal, School Education Department.

Counsel for the State, Ms. Bhattacharya, submits that the petitioners have to apply in terms of the Circular dated 6th May, 2019, before the concerned District Inspector of Schools, who is required to submit an application in terms of the format required under the order dated 6th May, 2019, issued by the Administrative Branch, School Education Department. The latter is required to thereafter forward the same to

the Joint Director (Accounts) for further action from their end.

In that view of the matter, the petitioners shall, within a period of ten days from date, make such application and file the same before the concerned District Inspector of Schools. The concerned District Inspector of Schools after receiving the said application, obtain any further clarification from the petitioners and forward the same after due satisfaction to the Joint Director (Accounts) of the School Education Department, Government of West Bengal, for further action and release of entitlement of 3% in accordance with law.

The aforesaid exercise shall be completed by the concerned District Inspector of Schools, within a period of two months from date of receipt of the application of the petitioners.

The Joint Director (Accounts), Commissioner of School Education, and District Inspector of Schools upon satisfaction of all the criteria, recommend release and afford 3% increment along with arrears to the petitioners, within a period of two months thereafter. With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
