For the Private Respondents Report submitted by the State is taken on record. Learned counsel for the petitioner submits that the private respondents are constructing a temple by encroaching upon the petitioner's land which was objected to by the petitioner and complaint lodged. The complaint has been registered as FIR and investigation has commenced. After the said complaint was lodged the petitioner has been driven out of her house with her family members by the private respondents who are local villagers and is not being allowed to return thereto. The petitioner seeks protection so that she is able to return to her house.
Learned counsel for the private respondents denies and disputes the allegation made by the petitioner. Learned counsel for the State submits that the police is not aware that the petitioner is not able to enter her house.
Be that as it may, since the petitioner intends to return to her house with her family members she will
approach the local police authorities and inform the intended date and time of her return to her house with her family. The police authority shall render necessary assistance to the petitioner and her family in order to enable them to return to the house.
The police shall also provide necessary protection/assistance to the petitioner and her family members so that they are able to reside in their house peacefully and without any disturbance whatsoever at the behest of the private respondents. The police shall keep strict vigil in the area in order to avoid any untoward incident in view of the strained relationship between the parties and shall ensure maintenance of peace and tranquility. The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
