The petitioner has filed the present writ application praying for grant of electric connection.

By an order dated December 4, 2025, this Court directed the CESC to inspect the premises of the petitioner and to submit report. In compliance of the order dated December 4, 2025, the CESC has submitted the report wherein it reveals that on December 5, 2025, the premises of the petitioner was inspected. In the report it is mentioned that the petitioner is living separately and she is entitled for a new loop meter at the existing meter board position subject to necessary direction from the court of law. 3.

The report further reveals that the co-sharers have handed over the copy of the order passed by the learned Civil Judge (Senior Division), 7th Court at Alipore in Title Suit No. 965 of 2025 wherein the learned Court had directed the parties to maintain status quo with regard to the nature, character and possession of the suit property till July 31, 2025 4.

The learned counsel for the petitioner submits that she is also the party to the suit being the defendant in the

said suit. The learned counsel for the petitioner submits that though there was an order of status quo but it is settled law that the status quo will not prevent the CESC for providing electric connection in the premises of the petitioner.

The petitioner has relied upon a judgment in the case of Sk. Samsud Doha Vs. West Bengal State Electricity Distribution Company Limited & Ors. reported in 2012 (5) CHN (Cal) 772 wherein the co-ordinate Bench of this Court has held that order of status quo as to the nature, character of the suit property is not violated by affecting electric supply to an admitted occupier of such property.

In the present case also there is no denial that the petitioner is in occupation of the property. It also appears from the report that the petitioner is not having electric meter. The CESC authorities are ready and will to provide the new loop meter from the existing meter board position subject to compliance of all formalities by the petitioner.

In view of the above, CESC limited is directed to supply the new loop meter from the existing meter board position in the premises of the petitioner within a period of four weeks from the date of compliance of all the formalities by the petitioner.

It is made clears that if the authorities find that any persons are obstructing the CESC for providing electric connection in the premises of the petitioner in terms of this order, the petitioner can approach the concerned

police authority i.e., the respondent no. 3, the respondent no. 3 shall provide appropriate police assistance to the CESC officials as well as to the petitioner for providing electric connection in the premises of the petitioner.

Accordingly, WPA 25509 of 2025 is disposed of.

10. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
