Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioners and the private respondents have disputes as the learned advocate appearing for the petitioners contends that the petitioners are Bargadars and they are being obstructed from harvesting the crops. On the other hand, the learned advocate appearing for the private respondents opposes the same and submits that their right of Bargadar was terminated. In spite of that, they are pursuing to harvest crops which have been cultivated by the private respondents.

Learned advocate appearing for the State has submitted a report which reflects that the police authorities have kept a sharp vigil over the said land.

The petitioners, if they have a right under the law would approach the jurisdictional civil court for appropriate orders in terms of harvesting or cultivation of the said plot of land. So far as this Court is concerned, this Court directs the Inspector-in-Charge, Canning Police Station to see that no untoward incident stems out of the prevailing relationship between the petitioners and the private respondents.

With the aforesaid observations, the writ petition being WPA 25949 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
