The petitioner is the minor son of a deceased teacher. The minor is represented by his father. The mother of the petitioner died-in-harness on November 28, 2014. After the death of the teacher, her husband received family pension. Epension payment order was issued in his favour on August 16, 2017. The father of the petitioner has remarried on October 15, 2017. Prayer for family pension in favour of the minor son is pending consideration at the end of the respondent authorities.

After hearing the parties, I dispose of the writ petition by directing the Director of Pension, Provident Fund & Group Insurance, West Bengal to consider the prayer of the petitioner at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

All consequential steps to release the family pension in favour of the petitioner shall be taken

thereafter.

Learned counsel for the petitioner shall forward a copy of the representation for family pension along with all supporting documents to the said respondent at the time of communicating this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
