1. By this application, the petitioner seeks expeditious disposal of Matrimonial Suit No.389 of 2021, which is pending before the learned Additional District Judge, Fast Track Court, Kalyani, Nadia.

2. It is submitted that the petitioner lives in Canada and it is difficult for him to contest a suit which may go on for a considerable time. The wife filed the suit for divorce. It is submitted that the wife has also prayed for maintenance and it is submitted that regular maintenance is being paid.

3. Considering the submissions, this Court is of the view that the prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties.

4. Under such circumstances, the revisional application is disposed of with a direction upon the learned court to dispose of the suit as expeditiously as possible, preferably within a period of one year from the date of communication of this order, provided the husband pays the maintenance, allowed by the court, in

accordance with law. In case of default in payment or non-payment, the suit shall not proceed. Adequate opportunity shall be given to the parties to contest the same.

5. This court has not expressed any opinion on the merits of the suit. The learned court shall proceed independently and in accordance with law.

6. The revisional application is accordingly disposed of.

7. There shall be no order as to costs.
