1. Learned counsel appearing for the petitioner submits that although the injury inflicted was severe, the petitioner had hardly any role to play. The principal accused was arrested and he is in custody. Charge-sheet has been submitted.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He refers to the statements of witnesses including the victim as also the two injury reports. It appears that two persons were seriously injured by the petitioner and the other accused. One of the fatal blows to the abdomen of the victims was given by one Tapas Hazra. The petitioner and others allegedly took active role in assaulting the said victim and another.
3. Considering the incriminating materials available in the case diary and the alleged role ascribed to the petitioner, I
am not inclined to grant anticipatory bail to the petitioner.
4. Accordingly, the application for anticipatory bail is rejected.
5. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
