Criminal Revisional Jurisdiction 19-10-2023 Subha Item no. 24 Ct no.34 CRR 4223 of 2023 Soumojoy Majumdar -versus- Smt. Ishani Ghosh Mr. Supriya Chattopadhyay Mr. Sudip Kumar Maiti Mr. Subhajyoti Chandra ..for the petitioner.

On 14th September, 2023, the learned Judicial Magistrate, 2nd court(in-charge), Barrackpore in Misc. Execution Case No. 07 of 2023 was pleased to issue warrant of arrest fixing the next date on 9th November, 2023. The said order also reflects that the opposite party has filed statement of accounts. If the statement of accounts reflects that whole of the amount has been paid, then in that case the learned Judicial Magistrate(in-charge), Barrackpore will drop the proceedings. If there are any arrears, the learned court will grant one week's time to clear the arrears.

The execution of the warrant of arrest is stayed till 9th November, 2023. The learned Judicial Magistrate(in-charge), Barrackpore will asses regarding the statement of accounts, decide and thereafter either recall the warrant of arrest or give an opportunity of a week for clearing the dues of arrears which have accumulated.

With the aforesaid observations, the present revisoinal

application being CRR 4223 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
