In the matter of : Sourav Bhojnagarwala .......petitioner Mr. Arijit Ganguly Mr. Saryati Dutta ....for the State The revisional application was preferred for challenging the proceedings arising out of Park Street police Station case no. 160 of 2012 dated 3.5.2012 under Sections 120B/420/506 of the Indian Penal Code.

Record of the revisional application reflects that by an order dated 28.9.2012 a coordinate bench of this court was pleased to direct that since investigation is in progress, no ground for stay has been made out.

As none appears for the petitioner or for the State. Mr. Saryati Dutta, learned advocate who usually appears for the State, was directed to appear in this matter for rendering his assistance to this court. His appointment may be regularised by the concerned authorities.

Having regard to the fact that the investigation of the case was in progress and the outcome of this investigation has not been brought to the notice of this court by the petitioner, I am of the view that no interference is called for at this belated stage which is bound to prejudice the prosecution after 9 years. As such no interference is called for.

Accordingly, CRR 3408 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
