The petitioners are aggrieved by the mutation granted by the Kolkata Municipal Corporation in favour of some of the private respondents.

Submission of the petitioners is that the mutation ought not to have been granted in favour of Mira Pal Chowdhury, Rama Prasad Pal Chowdhury, Uma Prasad Pal Chowdhury and Shyama Prasad Pal Chowdhury.

The petitioners assert that they are the owners of the subject property and the same could not have been mutated in favour of the aforesaid persons.

Upon hearing the submission made by the petitioner no.1 appearing in-person and upon perusal of the materials on records, it appears that the petitioners are yet to file a comprehensive representation before the Corporation highlighting their grievances.

In view of the above, the instant writ petition is disposed of by granting liberty to the petitioners to file

a proper representation giving all facts and highlighting their grievances.

In the event such a representation is made, the same shall be considered by the Assessor Collector (S.S.Unit, K.M.C.) after giving reasonable opportunity of hearing to all the necessary parties at the earliest but positively within a period of eight weeks from the date of filing the representation.

A reasoned order shall be passed and communicated to the parties.

The Officer-in-Charge, Behala P.S. is directed to ensure that no breach of peace takes place in the locale where the petitioners are residing and no harm is caused to the life and property of the petitioners. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
